The fine print
Terms of Use
The plain-language rules for using this site — shorter and friendlier than most, but they still count.

Who We Are
This site (pokeskye.com) is operated by Poke Skye LLC, a Florida limited liability company — referred to in these terms as “Poke Skye,” “we,” “us,” and “our.” “You” means whoever is using the site.
Behind the entity it's a family-run project: Skye runs the shop and her parents review, pack, and ship every order. The site has three wings: free price guides, a free deal radar, and a shop window for our own eBay listings.
By using the site, you agree to these terms. If you don't agree with them, please don't use the site. If you're a kid, have a grown-up read them with you — and if you're under 18, a parent or guardian has to agree to these terms for you.
Buying on eBay
Apart from the Shopify checkout described below, this website processes no payments. Every card we list is also on our eBay store, and every deal our radar surfaces links to a listing on eBay. When you buy on eBay, the transaction happens there under eBay's User Agreement and is covered by the eBay Money Back Guarantee. For those purchases, payment, shipping disputes, returns, and buyer protection are all governed by eBay's policies — that's a feature, not a dodge: it means a large, established marketplace stands behind the purchase.
Buying Here on Poke Skye
Some Buy It Now cards also carry an Add to cartbutton. That cart checks out on Shopify for our store, and we pack and ship the card ourselves. These purchases happen outside eBay, so eBay's buyer protection doesn't cover them.
Shipping, returns and refunds for these purchases follow our store policies shown at checkout. A card's price here and on eBay are set separately and can differ; each is shown with its own checkout.
About Our Price Data
Price guides. Our price guides combine market prices from TCGplayer (USD) and Cardmarket (EUR) with live eBay listing data. All of it is informational only: estimates of market conditions, not appraisals, not valuations, not offers to buy or sell, and not financial or investment advice. Card prices move, data can lag, and we don't guarantee accuracy or completeness. Before you spend real money, verify the listing yourself — our methodology page explains exactly where every number comes from.
Fair value and deal verdicts. The deal radar compares a listing's asking price against a fair-value benchmark we compute from market data, then labels the gap. That label is our opinion about one moment in a moving market — not an appraisal, not a guarantee of resale value, and not a recommendation to buy. Fair value can be wrong, a listing can be misdescribed, and a card we call a deal can turn out not to be one.
Grading information. When we show a grade — PSA 10, CGC 9.5, and so on — we're repeating what the grading company's label and the seller's listing say. We don't grade cards, we don't authenticate them, and we can't confirm that a slab is genuine or that its grade is accurate. Each grading company stands behind its own grade; our grading guide explains what the numbers mean, it doesn't certify them.
Acceptable Use
Browse, search, share links, and cite our pages as much as you like. Please don't: attempt to break, overload, or probe the site's security; scrape at volumes that degrade the site for everyone else; misrepresent our data as your own; or use the site for anything unlawful. We may block access that abuses the site — we'd rather not, so don't make us.
Intellectual Property
Our content. The site's original writing, design, code, and characters (Skye, Lola, and Volt) are © Poke Skye LLC. Cite us with a link; don't republish wholesale.
Pokémon trademarks. Poke Skye is an independent fan project, not affiliated with, endorsed, sponsored, or approved by Nintendo, Game Freak, Creatures Inc., or The Pokémon Company. Pokémon and all related names, marks, and images are trademarks and copyrights of their respective owners; no ownership is claimed. Card images appear on this site for identification purposes — so you can tell exactly which card a price refers to.
Affiliate Links
Some outbound eBay links are eBay Partner Network affiliate links: if you buy through one, eBay pays us a small commission. It never changes your price — a listing costs exactly the same with or without our link, and we never rank deals by what pays us.
No Warranties
We work hard to keep this site accurate and online, but we can't promise it will always be either — prices may be stale, listings may have ended, and features may change or break. So the formal version:
The site and everything on it are provided “as is” and “as available,” without warranty of any kind. To the fullest extent the law allows, we disclaim all warranties, express, implied, and statutory, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade. We don't warrant that the site will be uninterrupted, timely, secure, or error-free, or that any price, fair value, deal verdict, grade, or other information on it is accurate, current, or complete. Data we receive from third parties — TCGplayer, Cardmarket, eBay, and the grading companies — is passed along as we receive it, without warranty from us.
Limitation of Liability
In plain words: use your own judgment when you spend money, don't bet more than you'd be okay losing on any collectible, and understand that a free price guide can't underwrite your purchases. The clause that says so:
Damages we're not liable for. To the fullest extent permitted by law, Poke Skye LLC and its members, managers, family operators, and contractors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost opportunity, or loss of goodwill, arising out of or relating to the site — including any purchase, sale, or hold decision you make using our price data, fair-value benchmarks, deal verdicts, or grading information. This applies even if we were told such damages were possible.
The cap on what we owe. Our total liability for all claims relating to the site will not exceed the greater of (a) the total affiliate commission we actually received in connection with your use of the site in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100). That figure is deliberately small because it matches the shape of what we actually do: the site's guides and tools charge you nothing, take no payment, hold no funds, and earn only a small eBay Partner Network commission if you happen to buy through one of our links (an order placed in our shop is governed by the Terms of Sale, which cap liability at what you paid for that order). These limits are an essential part of the bargain that lets us publish the guides for free.
What this cap does not touch. Nothing here limits your rights against eBay or an eBay seller: eBay purchases are governed by eBay's terms and the eBay Money Back Guarantee, and this section doesn't reduce that protection; orders placed here are governed by our Terms of Sale and refund policy. Nothing here excludes liability for fraud, fraudulent misrepresentation, gross negligence, willful misconduct, death or personal injury caused by our negligence, or anything else that cannot lawfully be limited or excluded. Some jurisdictions don't allow certain exclusions, so parts of this section may not apply to you; where that's the case, our liability is limited to the smallest amount the law allows.
Governing Law and Venue
These terms, and any dispute arising out of them or out of your use of the site, are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Subject to the arbitration section below, any dispute that isn't arbitrated will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you and we each consent to personal jurisdiction there.
Disputes and Binding Arbitration
This is the densest part of the document, so here it is in plain words first: if something goes wrong, email us and we'll try to fix it. If we can't, most disputes get decided by a neutral arbitrator instead of a judge and jury, one person at a time rather than as a class action. Small-claims court always stays open to you, and you can keep your right to go to court on everything by opting out within 30 days.
Talk to us first. Before either of us starts an arbitration, the complaining side has to send a written notice of dispute — for you, an email to hello@pokeskye.com describing the problem and what you'd like done about it — and give the other side 30 days to sort it out. Most things end here.
Agreement to arbitrate. If those 30 days pass without a resolution, you and Poke Skye LLC agree that any dispute, claim, or controversy arising out of or relating to these terms, the site, our price data, or our affiliate links will be resolved by binding individual arbitration rather than in court, except for the carve-outs below. This agreement is governed by the Federal Arbitration Act.
Provider and rules. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and Mediation Procedures in effect when the demand is filed. If the AAA is unavailable or declines to administer the case, you and we will agree on another established consumer arbitration provider; if we can't agree, a court in Miami-Dade County may appoint one.
Where it happens. The seat of the arbitration is Miami-Dade County, Florida, and the arbitrator applies Florida law. Under the AAA's consumer rules, hearings are held virtually by default and smaller disputes are usually decided on documents alone, so in practice most claims never require anyone to travel; if an in-person hearing is held, it will be in Miami-Dade County unless you and we agree otherwise. The arbitrator can award any individual relief a court could, and the award may be entered as a judgment by any court with jurisdiction.
One at a time — no class actions. Claims may be brought only in your individual capacity. Neither you nor we may bring a class, collective, consolidated, or representative action, and the arbitrator may not consolidate more than one person's claims or preside over any form of class or representative proceeding.
No jury trial. By agreeing to arbitrate, you and we both give up the right to a trial by jury and the right to have covered disputes decided by a judge, except as the carve-outs below allow.
Small-claims carve-out. Either of us may instead bring an individual claim in small-claims court — in Miami-Dade County, or wherever you live — so long as the claim stays in that court and stays individual.
Injunctive relief and intellectual property. Either of us may ask a court for a temporary restraining order or other injunctive relief, and we may go to court over claims that someone is infringing or misusing our intellectual property (our writing, design, code, characters, and marks) or scraping, probing, or intruding on the site. Doing either doesn't waive the rest of this section.
Who pays. The AAA's Consumer Arbitration Fee Schedule decides who pays what, and it puts nearly all of the cost on the business: you pay a capped consumer filing fee and we pay the remaining AAA administrative fees and the arbitrator's compensation. If the arbitrator finds a claim was frivolous or brought in bad faith, the AAA rules allow those fees to be reallocated. Otherwise each side pays its own attorneys' fees unless the law or the award says differently.
Your 30-day opt-out. You can decline this arbitration agreement and keep your right to go to court. Email hello@pokeskye.com with the subject line “Arbitration Opt-Out” within 30 days of the first time you use the site on or after September 2, 2026, and include the name and email address we should confirm back to. Opting out costs you nothing, changes nothing else about your use of the site, and we won't hold it against you — if you opt out, the governing-law and venue section above applies instead.
If part of this doesn't hold. If the no-class-actions paragraph is found unenforceable as to a particular claim or a particular request for relief, that claim or request is severed and goes to the courts in Miami-Dade County while everything else stays in arbitration. If any other part of this section is found unenforceable, the rest of it still applies. This section survives the end of your use of the site.
Changes to These Terms
We may update these terms as the site grows. When we do, we'll update this page and the “last updated” date at the top; continued use of the site after a change means you accept the new terms. For a significant change, we'll say so prominently rather than bury it.
If we ever materially change the arbitration section, the 30-day opt-out window opens again from the new last-updated date, so a change to that section can never quietly take away a right you still had.
